Acceptable Use Policy

This Acceptable Use Policy ("AUP") applies to the managed hosting and related services ("Services") provided by SWS Solutions ("we", "us", or "our") to our customers ("Customer", "you", or "your").
By using our Services, you agree to comply with this AUP, our Terms and Conditions, and all applicable laws and regulations.
1. Scope of the Services
Our Services consist of privately managed hosting and related infrastructure services provided to customers on an individual, customer-specific basis.
Our managed hosting services may include, depending on the customer's agreement with us:

Website and application hosting;

Server and infrastructure management;

Storage and database services;
-
Network and connectivity services;
-
Software installation and configuration;
-
Security, maintenance, monitoring, and technical management; and
-
Other hosting or infrastructure services agreed upon with the Customer.
Because our hosting services are managed services, the specific software, applications, content, and services permitted on a customer's infrastructure may be determined or approved by us.
We reserve the right to refuse to host particular content, applications, services, or activities where we consider them unsuitable, unlawful, unsafe, excessively risky, or incompatible with our infrastructure or business.
2. Permitted Use
Customers may use our Services only for lawful and legitimate purposes and only for the purposes agreed upon with us.
Permitted use may include hosting legitimate websites, applications, business services, databases, files, and other content or services that we have agreed to host.
Use of our Services must not interfere with the security, availability, reliability, or normal operation of our infrastructure or the services of other customers.
3. Prohibited Use
Customers may not use, or permit others to use, our Services for activities that are unlawful, fraudulent, abusive, harmful, or that may reasonably cause damage to our infrastructure, our customers, third parties, or the wider Internet.
Prohibited activities include, but are not limited to:

Fraud, scams, deception, or other fraudulent activities;

Phishing or attempts to obtain passwords, credentials, payment information, or other sensitive information without authorization;

Malware, ransomware, viruses, trojans, spyware, or other malicious software;
-
Unauthorized access to computers, servers, networks, accounts, or systems;
-
Hacking, exploitation of vulnerabilities, or attempts to circumvent security controls without authorization;
-
Denial-of-service or distributed denial-of-service attacks;
-
Port scanning, network attacks, or other activities directed against third-party systems without authorization;
-
Distribution of malicious or harmful content;
-
Spam or other abusive bulk communications;
-
Activities intended to evade law enforcement, sanctions, or other legal restrictions;
-
Hosting or distributing content that violates applicable law;
-
Copyright, trademark, or other intellectual-property infringement;
-
Distribution of stolen, unlawfully obtained, or unlawfully shared information;
-
Using our infrastructure to facilitate criminal activity;
-
Cryptocurrency mining or other activities that consume disproportionate resources unless expressly approved by us;
-
Operating services that create an unreasonable security, legal, operational, or reputational risk to us or our infrastructure without our prior approval; and
-
Any other activity that we reasonably determine to constitute abuse or misuse of our Services.
4. Restricted or High-Risk Activities
Certain activities may present increased security, legal, operational, or reputational risks.
Customers must obtain our prior approval before using our Services for activities that we consider high-risk or unsuitable for our infrastructure.
We may refuse, restrict, or impose additional conditions on such activities at our discretion.
Where appropriate, we may require additional information from a Customer regarding the purpose and operation of a service before agreeing to host it.
Approval of an activity does not prevent us from subsequently restricting or terminating it if circumstances change or if the activity creates an unacceptable risk.
5. Compliance With Laws and Regulations
Customers must use our Services in compliance with all applicable laws, regulations, and legally binding requirements.
This includes, where applicable, laws relating to:

Computer misuse and unauthorized access;

Fraud and financial crime;
-
Intellectual property;
-
Data protection and privacy;
-
Consumer protection;
-
Sanctions and export controls; and
-
The distribution or publication of unlawful content.
Customers must not use our Services to circumvent applicable sanctions, embargoes, export controls, or other legal restrictions.
We may refuse or terminate Services where providing or continuing the Services would cause us to violate applicable law or expose us to significant legal or regulatory risk.
6. Customer Responsibility
Customers are responsible for the content, data, applications, services, and other materials that they provide to us or request us to host, install, configure, or manage.
Where a Customer permits third parties, employees, contractors, clients, users, or other persons to access or use a hosted service, the Customer remains responsible for ensuring that those persons comply with this AUP and the Customer's agreement with us.
Customers must not knowingly permit their hosted environment to be used for prohibited activities.
Customers must also provide us with accurate and sufficient information where reasonably necessary for us to provide, manage, secure, or investigate the Services.
7. Security
Customers must take reasonable steps to protect accounts, credentials, applications, and other systems associated with their Services.
Customers must promptly notify us if they become aware of:

Unauthorized access;

Compromised credentials;
-
Malware or malicious activity;
-
A security vulnerability that could affect our infrastructure; or
-
Any other security incident that could materially affect the Services.
We may take reasonable measures to protect our infrastructure and other customers, including temporarily restricting or isolating affected systems.
8. Monitoring and Investigation
We may monitor or investigate the use of our Services where reasonably necessary to:

Protect the security, integrity, and availability of our infrastructure;

Investigate suspected violations of this AUP;
-
Prevent fraud, abuse, or other harmful activity;
-
Comply with legal or regulatory obligations;
-
Respond to lawful requests from competent authorities; or
-
Protect our business, customers, or third parties.
Because our Services are managed hosting services, we may also review or manage hosted services and configurations as reasonably necessary to provide the contracted service and maintain the security and reliability of our infrastructure.
We do not guarantee continuous monitoring of all content or activity and are not responsible for proactively identifying every violation of this AUP.
9. Enforcement
If we reasonably believe that a Customer or hosted service violates this AUP, we may take appropriate action depending on the circumstances.
Such action may include:

Requesting that the Customer correct the violation;

Removing or restricting access to affected content or services;
-
Blocking network traffic or specific activities;
-
Temporarily suspending a service;
-
Isolating or securing an affected system;
-
Suspending or terminating a Customer's account or Services;
-
Refusing to provide or continue providing a particular service; or
-
Reporting suspected unlawful activity to the appropriate authorities where required or appropriate.
We may take immediate action where we reasonably believe that continued operation presents a significant security, legal, operational, or other risk.
Where circumstances permit, we may notify the Customer before taking enforcement action or provide an opportunity to remedy the violation.
10. Abuse Reports
Reports concerning suspected abuse, unlawful activity, security incidents, or violations of this AUP may be submitted to:

Reports should include sufficient information for us to understand and investigate the alleged activity.
We may request additional information where necessary.
11. Third-Party Services
Where our Services involve third-party software, infrastructure, networks, data centers, providers, or other services, Customers must also comply with any applicable restrictions imposed by those providers.
A Customer may not use our Services in a manner that causes us to violate the terms or acceptable-use requirements of an upstream provider.
12. Changes to the AUP
We may update this AUP from time to time to reflect changes to our Services, applicable laws, security practices, or business requirements.
The current version of this AUP will be made available on our website.
Continued use of our Services after an updated AUP becomes effective constitutes acceptance of the updated policy, to the extent permitted by applicable law.
